Addressing a case of first impression in Massachusetts, Richard Gentilli and Thomas Looney successfully argued a motion for summary judgment in the Superior Court resulting in a holding that there are no Constitutional or jurisdictional impediments to a creditor pursuing a judgment debtor’s assets, wherever such assets are located, even where the judgment debtor would otherwise not be subject to personal jurisdiction in Massachusetts.
This decision was obtained after a bitterly contested legal proceeding and is of considerable precedential significance. The Superior Court ruling received front page coverage in the Massachusetts Lawyers Weekly.
