Business Litigation

Overview

Hackett Feinberg delivers veteran business litigation prowess in resolving high-stakes, complex commercial disputes of all kinds. Our wealth of experience allows us to assist an array of business entities, ranging from Fortune 500 companies to small businesses and everything in between.

We focus on accomplishing each client’s distinct goals in an efficient and cost-effective manner. We are proven problem solvers who defend the rights of individuals, entrepreneurs, businesses, nonprofits, and institutional clients faced with state and federal court commercial litigation claims.

Our ability to realize each client’s distinct end game is the result of decades of hard-earned skill. As a result, we are nimble business advisors and advocates who are often far more effective litigators when wise and quick decisions, in collaboration with our clients, must be made. Where others may have faltered, we have created resolution among even the most disparate party positions involved in disputes in Massachusetts and throughout New England.

We defend businesses in civil bench and jury trials in state and federal court litigation; alternative dispute resolution (ADR), such as mediation and arbitration; and on appeal. Notably, we maintain a significant track record of favorable trial and appellate results. We know how to position arguments for success at the trial court level, and if necessary, on appeal.

We resolve a wide variety of business disputes. This includes bet-the-company claims and other difficult negotiations, sometimes valued in the tens of millions of dollars. We have resolved litigation involving corporate freeze-outs and other shareholder or partnership disputes, violations of noncompetition agreements, lawsuits arising out of the sale of businesses and other assets, commercial lease defaults and violations, complex insurance coverage and liability matters, claims of breach of fiduciary duty, cases involving the Uniform Commercial Code, violations of Massachusetts Chapter 93A, and myriad other business torts.

Whether a business dispute hits the headlines, calls for behind-the-scenes discrete negotiation, or requires honed state and federal court advocacy, we have been there before. Our fluency in corporate law, contractual obligations, and other business torts make us highly sought out as lead counsel on practically every kind of business dispute and across various industries throughout New England.
